Information clause

By fulfilling the obligation of the administrator of personal data provided in connection with cooperation with the Business Partner on the basis of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (general regulation on data protection) of 2016-04-27 (Journal of Laws EU.L 2016 No. 119, page 1) (hereinafter: GDPR) we inform that:

  1. The administrator of the personal data provided is Biuro Inżynierskie Automatyki Przemysłowej Sp. z o.o. with its registered office in Wrocław at ul. Muchoborska 16 54-424 Wrocław., A company entered in the Register of Entrepreneurs kept by the District Court for Wrocław - Fabryczna in Wrocław, VI Commercial Department of the National Court Register under the number: 0000013116; NIP: 8940006528., share capital 216,000.00. PLN, paid in full, hereinafter referred to as "the Administrator".
  2. Personal data provided in the system will be processed by the Administrator for the purposes of:
    1. concluding or performing contracts or conducting other business relations (including for the processing of orders, execution of deliveries or payments, or in the event of complaints, repairs or warranty claims), or for the purpose of preparing inquiries and answering them, determining the conditions governing contractual relations and participate in activities related to product development, with our customers, suppliers, service providers and competitors, whose representative or employee you are;
    2. providing your personal data within the Company for internal administrative purposes (e.g. for accounting purposes);
    3. ensuring IT security and IT processes;
    4. engaging service providers, in particular internal and external IT service providers supporting our business operations;
    5. conducting compliance proceedings;
    6. ensuring the security of buildings and plants (including video monitoring to the extent necessary to protect the premises).
  3. The legal basis for the processing of personal data are the provisions governing the rules for the processing of personal data, including the processing of personal data via means of distance communication, and from 25 May 2018, the provisions of the GDPR, i.e.
    1. Art. 6 clause 1 lit. b) GDPR: the need to take action before the conclusion of the contract by the Administrator at your request - in the case of the purpose referred to in point 3 (1) above;
    2. Art. 6 clause 1 lit. c) GDPR: compliance with the legal obligation incumbent on the Administrator - in the case of the purpose referred to in point 3 (2) above, 5);
    3. Art. 6 clause 1 lit. f) GDPR: Administrator's legitimate interest - in the case of the purpose referred to in point 3 (3), 4), 6) above;
    4. Art. 6 clause 1 lit. a) GDPR: based on a separate consent - in the case of the purpose set out in point 3 (6) above.
  4. The recipients of your personal data will be contractors cooperating with BIAP SP. zoo. within a given project.
  5. Period for which personal data will be stored:
    1. personal data processed in order to conclude or perform the contract and fulfill the Administrator's legal obligation will be stored for the duration of the contract, and after its expiry for the period necessary to:
      1. after-sales customer service (e.g. complaint handling);
      2. securing or pursuing any claims of the Administrator;
      3. fulfillment of the Administrator's legal obligation (e.g. resulting from tax or accounting regulations).
    2. personal data processed for the purposes of marketing the Administrator's products or services based on a legitimate legal interest will be processed until an objection is lodged by the data subject;
    3. personal data processed on the basis of a separate consent will be stored until its revocation, with the Administrator being entitled to process personal data despite revocation of consent, if the processing for this purpose is authorized on a legal basis other than consent.
  6. Your rights in relation to the processing of personal data by the Administrator:
    1. the right to access your personal data;
    2. the right to rectify data if the data processed by the Administrator is incorrect or incomplete;
    3. the right to request the Administrator to delete data;
    4. the right to request the Administrator to limit data processing;
    5. the right to transfer data, i.e. the right to receive personal data provided to the Administrator and send it to another administrator;
    6. the right to object to the processing of data based on the justified interest of the Administrator or to the processing for direct marketing;
    7. the right to lodge a complaint with the Polish supervisory body or supervisory body of another Member State of the European Union, competent for the place of habitual residence or work of the data subject or for the place of alleged violation of the GDPR the right to withdraw consent at any time (without affecting the lawfulness of the processing that was carried out on the basis of consent before its withdrawal).
  7. Your personal data will not be subjected to automated processing by the Administrator, including profiling.
